In short
- Every photograph in the Archive belongs to the photographer named in its credit. Panchrome owns none of them.
- Panchrome shows them on its website and social media, always credited. We never sell or license them, and the only changes we make are size, file name, alt text and SEO.
- You may look at them. You may not download, copy, screenshot for reuse, repost, edit, print or use them, for any purpose including personal use, without the photographer's written permission.
- Panchrome Connect is proprietary software. Copying, scraping or reverse engineering it, or using what you see inside it to imitate our service, is prohibited and will be pursued.
- Our name, brand, content and confidential know-how are protected. Imitation and passing off will be pursued.
- Photographers can withdraw their work at any time by writing to us.
Part 1About this document
1.1 Who we are. The Panchrome Project is a sole proprietorship of Vishal Kullarwar, with its registered address at 12, Shitla Darshan, Plot No. 375, L J Road, Mahim West, Mumbai - 400016, Maharashtra, India, and its operational address at A7, Silver Queen Apartments, Soonawala Agiary Lane, Mahim West, Mumbai - 400016, India ("Panchrome", "we", "us"). The Panchrome Collective is the name of our community of film photographers. It is operated by The Panchrome Project and is not a separate legal entity.
1.2 Who this applies to. This document applies to three groups. One person can belong to more than one.
Part 2 applies to Users. Part 3 applies to everyone. Parts 4 to 6 deal with the Archive and community work. Parts 7 and 8 apply to everyone.
1.3 Agreement. By using our websites you agree to this document. Users and Contributors accept it by ticking the box shown when they sign up or submit, and we record the date and time. If you do not agree, please do not use our websites, Connect or the Archive.
1.4 Other documents. This document works together with our Terms of Service and Privacy Policy, both available at the foot of our website, and our Community Submission Guidelines. If anything here conflicts with the Community Submission Guidelines about how a Contributor's work may be used, the term that better protects the Contributor applies.
Part 2Panchrome Connect
2.1 What Connect is. Panchrome Connect™ (the "Platform"), at connect.panchromeproject.com, is our logged-in platform for customers. It brings together services, orders, order timelines, film processing updates and event tickets in one place.
2.2 Ownership. The Platform and every part of it belong to Panchrome, including:
These are protected under Indian law, including the Copyright Act, 1957, the Trade Marks Act, 1999, the Information Technology Act, 2000, and the law of confidence and trade secrets, as each applies to the relevant part, and under international treaties including the Berne Convention and the TRIPS Agreement. Nothing in this document transfers any ownership to you.
2.3 Third-party components. Parts of the Platform rely on services and software owned by others, including Shopify for customer accounts and payments. Those belong to their owners and are governed by their own terms. Our ownership covers the original software, design and content created by or for Panchrome.
2.4 Limited permission. We give you a limited, personal, revocable, non-exclusive and non-transferable permission to use the Platform only to access services Panchrome provides to you. All other rights are reserved. No other licence arises by implication, conduct or otherwise.
2.5 What you must not do. You must not, and must not help or allow anyone else to:
2.6 Confidential information. What you see in the non-public parts of the Platform, including its internal workings, features, processes and business information, is confidential to Panchrome. Use it only to receive our services and keep it confidential, including after your account ends. This does not apply to information that is public through no fault of yours, that you already lawfully held, that you developed independently without using ours, or that the law requires you to disclose.
2.7 Your content and feedback. You keep ownership of the photographs, files and information you upload to Connect. You give Panchrome a licence to store, process and display them only to provide our services to you. Ideas and feedback you give us about the Platform may be used by Panchrome freely, and the resulting improvements belong to Panchrome.
2.8 Monitoring. We log and monitor access to and activity on the Platform to protect its security and our intellectual property. Logs may be used as evidence in legal proceedings. Personal data is handled as set out in our Privacy Policy.
2.9 Licensing. The Platform and its underlying technology are available for licensing to film labs, distributors, retailers, educators and other businesses, in India and internationally. A licence exists only in a written agreement signed by Panchrome. None arises from using the Platform, from correspondence or from a demonstration. Licensing enquiries: support@panchromeproject.com.
2.10 Consumers. Where you use Connect as a consumer, nothing in this document limits your rights under the Consumer Protection Act, 2019 or any other law.
Part 3Copying, imitation and misuse of how Panchrome operates
3.1 What we protect. Panchrome has built its platform, processes and community over years. The following are protected to the extent the law allows:
The names of other businesses, including partner labs such as Darkroom8 and Safelight, belong to their owners.
3.2 How the law protects them. Copyright in India protects how something is expressed, such as code, screens, text, designs, databases and documents. It does not protect a bare idea. Panchrome therefore relies on the full range of protection the law gives:
3.3 What counts as copying or imitation. Each of the following is treated as copying or misuse:
3.4 What this does not restrict. We welcome fair competition and a strong film community. This document does not stop anyone from building their own service independently, without copying our code, content, designs or documents, without using our confidential information, and under their own name.
3.5 Consequences. Where we find copying, imitation or misuse, Panchrome may, at its sole discretion and without notice:
3.6 No licence by silence. If we do not act straight away, that is not permission and does not waive any right.
3.7 Report copying. If you see a website, app, product, event or business copying or imitating Panchrome, please write to support@panchromeproject.com.
Part 4The Panchrome Archive and community work
4.1 What the Archive is. The Panchrome Film Archive (the "Archive") is a guide to how film stocks look, with a community gallery of photographs by members of The Panchrome Collective and other Contributors. The rolls are processed by our lab partners, in house by Panchrome, or by the photographers themselves.
4.2 Our word. Contributors share their work with us because they trust us. This Part is that trust, written down, and it binds Panchrome.
4.3 Who owns what. "Credited Photographer" means the person whose name or social media handle appears in the credit shown with an image.
The Credited Photographer
- Owns the copyright in the image
- Holds every right to reproduce, publish, adapt, print, license and sell it
- Is named in the credit with every image
- Can withdraw the image at any time
The Panchrome Project
- Owns no copyright in any Contributor image and claims none
- Holds no right to sell, license or sublicense it
- May only display it on the website and social media for marketing and publicity (clause 4.4)
- Always shows the credit
4.4 What Panchrome is allowed to do. A Contributor gives Panchrome a non-exclusive, royalty-free, non-transferable and revocable permission to display the image, always with credit:
This is the full extent of Panchrome's use. Where the Community Submission Guidelines describe wider uses, Panchrome does not rely on them. We may pass the files to the technology providers that host and run our website, and only to the extent they need them to do so. For any image, this permission ends when the Contributor withdraws it under clause 4.9.
4.5 What Panchrome will never do. Panchrome will not, and will not allow anyone else to:
4.6 Credit. Every image is credited using the name or social media handle the Contributor provided. If a credit is wrong, incomplete or needs to change, write to us and we will correct it promptly.
4.7 No tampering. Panchrome does not alter any photograph before publishing it on the website. We do not edit, retouch, re-colour, colour grade, composite, filter, or add or remove elements from a photograph, or otherwise change what it shows. The only changes we make are:
None of these changes what the photograph depicts. Our Community Submission Guidelines allow cropping and light adjustment for layout. On the website we hold ourselves to the stricter standard in this clause. We respect each photographer's right to claim authorship of their work and to object to its distortion or modification (Section 57, Copyright Act, 1957).
4.8 What Contributors confirm. When you submit work, you confirm that:
If any of these is untrue for a submission made on or after 1 October 2026, you will compensate Panchrome for the losses and costs it suffers from claims arising from that, to the extent the law allows.
4.9 Withdrawal. A Contributor may withdraw any image at any time by writing to support@panchromeproject.com and identifying the image. We will remove it from the website and stop all further use promptly, within 7 business days. We will delete our own social media posts of it and ask search engines to remove cached copies we can reach. We cannot recall copies that others have taken, and use that has already happened is not affected. If someone has copied the image in breach of this document, tell us and we will help under clause 4.11.
4.10 Our right to decline or remove. We may decline or remove any submission that infringes copyright or privacy, is offensive or harmful, or does not meet our community standards. If someone raises a claim about an image, we may remove it first and investigate afterwards.
4.11 Enforcement for Contributors. Because copyright in each image belongs to its Credited Photographer, only the photographer, or someone with the photographer's authority, can bring a claim for infringement of it. Contributors authorise Panchrome to send takedown and infringement notices, and to take reasonable steps to stop unauthorised copying of their images from the Archive, at Panchrome's choice and without any obligation to do so. Panchrome will not license, settle or compromise any claim for a Contributor without the Contributor's consent. Contributors remain free to enforce their rights themselves.
Part 5Rules for everyone who views the Archive
5.1 What you may and may not do. You may browse the Archive and view the images on our pages for your own information and enjoyment. Beyond that, the table below applies.
You may
- View images on our website and social media
- Link to the Archive page or an image's page
- Use the share buttons on our website
- Share or repost our social media posts using the platform's own share feature, which keeps the credit
- Ask us to forward a request for permission to a photographer
You may not, without the Credited Photographer's written permission (Panchrome cannot give it)
- Download, save or copy an image, or screenshot or screen record it for reuse
- Reproduce, print, repost, upload, republish or redistribute it, including by re-uploading a file
- Edit, crop, filter, adapt or add to it
- Use it for personal use, including as wallpaper, in personal projects, on personal social media, in mood boards or in prints
- Use it commercially, including in advertising, merchandise, stock, client work, pitches, products or editorial
- Use it to train, test or improve any AI or machine learning model, or in any dataset or image recognition or search tool
- Scrape or bulk collect images or data from the Archive
- Remove, hide or change the credit or any information attached to the image
- Bypass any measure we use to protect images
- Present an image as your own or as Panchrome's
5.2 The personal use rule. The ban on personal use is deliberate. These photographs are personal work. A photographer decides if, where and how their work is used, and a Visitor's view that a use is harmless does not change that.
5.3 Asking permission. To ask for permission, write to support@panchromeproject.com with the link to the image's page, what you want to do and for how long. We may forward your request to the photographer, but we are not obliged to. Panchrome cannot grant permission. If the photographer agrees, the arrangement is directly between you and them, and Panchrome takes no commission.
5.4 What the law allows. This document does not authorise any use of an Archive image. Where Indian law allows a use without permission, such as fair dealing for criticism, review or reporting of current events under Section 52 of the Copyright Act, 1957, the law applies as it is written, and the photographer must still be credited. We do not encourage or assist such uses, and Panchrome has no power to grant or refuse them for a photographer.
5.5 Consequences of misuse. Misusing an Archive image infringes the photographer's rights, and the person who does so is responsible for it. The photographer, and Panchrome acting with their authority under clause 4.11, may:
Part 6Reporting, takedown and grievances
6.1 Copyright, credit or consent complaints. If you are a photographer or rights holder and you see work on our websites that you did not authorise, that is wrongly credited, or that you want removed, write to support@panchromeproject.com with:
We will act promptly, and we may remove the image while we look into it.
6.2 Privacy complaints. If you appear in a photograph and want it removed, write to support@panchromeproject.com with the link to the image's page. We will review it promptly.
6.3 Grievance Officer. In line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, our Grievance Officer is Vishal Kullarwar, reachable at vishal@panchromeproject.com, 12, Shitla Darshan, Plot No. 375, L J Road, Mahim West, Mumbai - 400016, Maharashtra, India. Complaints are acknowledged and handled within the time limits those Rules set.
Part 7Liability and disclaimers
7.1 As is. Our websites, Connect and the Archive are provided as they are. We take reasonable care but do not promise they will always be available or free of errors.
7.2 The film guide. How a film stock looks depends on the camera, lens, light, exposure, processing, scanning and screen. The Archive is a reference and a source of inspiration, not a promise of any result.
7.3 Content from others. We rely on the confirmations Contributors give us and act when a problem is reported. To the extent Panchrome acts as an intermediary for content that others provide, it has the protection of Section 79 of the Information Technology Act, 2000.
7.4 Limits. To the extent the law allows, Panchrome is not liable for indirect or consequential loss, loss of profit, or loss caused by third-party websites, services or users. Nothing in this document excludes any liability that cannot be excluded by law, or limits your rights as a consumer.
7.5 Indemnity. Business Users, and Contributors for the matters in clause 4.8, will indemnify Panchrome against losses, damages, claims, costs and reasonable legal fees arising from their breach of this document or their infringement of Panchrome's rights. An individual who uses Panchrome as a consumer is responsible only for loss caused by their wilful breach, and only to the extent the law allows.
Part 8General
8.1 Governing law and courts. This document is governed by the laws of India. The courts at Mumbai, Maharashtra have exclusive jurisdiction over any dispute arising from it. Panchrome may seek urgent injunctive relief in any court of competent jurisdiction, in India or abroad, where infringement occurs. This does not remove any right a consumer has to approach a consumer forum under the Consumer Protection Act, 2019.
8.2 If a part fails. If any part of this document is found unenforceable, that part is to be applied as narrowly as needed to make it enforceable, or otherwise removed, and the rest stays in full effect.
8.3 No waiver. Our failure or delay in enforcing any right is not a waiver of it.
8.4 What continues. The clauses on ownership, confidentiality, enforcement, indemnity and governing law continue after your use of our websites, Connect or the Archive ends.
8.5 Updates. We may update this document. The date at the top shows the latest version, and continued use means you accept it. We will not widen the permission a Contributor has given for their images without their fresh consent.
